Plea to Take Back Responsibility for “Peace and Quiet” Neighborhoods

The following is my recent anonymous plea to neighbors to honor “peace and quiet” and themselves/others enjoying it.... Perhaps it will be a useful example to inspire backbone in your US neighborhood, where backbone was surrendered many decades ago. My goal was to protect myself from backlash and to inspire action that requires co-activity. We shall see.

The rampant passivity and generalized stupefaction in the US-owned citizenry surpasses that of Stalinist Russia and Nazi Germany. It is obnoxiously present in neighborhoods where stranger-prisoners survive at most next to each other, as in prison bunkmates, or those awaiting the death "outside" inside a bunker together. The treatment of each other is appalling and gets worse every day.

The use of brain-numbing sodium fluoride in the water, focus-dissolving constituents proven to be in chemtrails, autism-causing taints injected into children as "vaccination", food-preservatives which turn brain matter black, a de-nutrifying FDA, and the somatizing by the combined triad of the insurance cartel, the pharmaceutical cartel, and the medical cartel (AMA was created by John D. Rockefeller) surely have much to do with it being so widespread and thorough. It's I.G. Farben all over again!

So much for Project Paperclip and the detent´ pushed by the New and Old Left seepage who sought state-capitalism to ration out any freedom and liberty; they only ideo-purified the elements in the current hybrid authoritarianism, and its "more-rational" manufacturing of a mass authoritarian personality to implement the Fabian Socialist "norm", of which George Orwell apparently gave warning to deaf ears, blind eyes, frozen smiles, rigid hips, and dead imaginations.

1.25.030 Public nuisance abatement

9.15.030 Loud or unnecessary noises prohibited.

Notwithstanding any other provision of this chapter, it is unlawful for a person to willfully make or continue, or cause to be made or continued, a loud, unnecessary, or unusual noise which disturbs the peace or quiet of a neighborhood, or which causes discomfort or annoyance to a reasonable person of normal sensitivity residing in the area. The standards which shall be considered in determining whether a violation of this section exists shall include, but are not limited to, the following:

A. Volume of the noise;
B. Whether the nature of the noise is usual or unusual;
C. Proximity of the noise to residential sleeping facilities;
D. Nature and zoning of the area within which the noise emanates;
E. Time of the day or night the noise occurs;
F. Duration of the noise;
G. Whether the noise is recurrent, intermittent, or constant; and
H. Whether the noise is produced by a commercial or noncommercial activity. (Ord. 446 § 1, 1980; 1991 code § 5-1.3)

9.15.040 Special noise sources

E. Animals or birds in residential neighborhoods. No person shall keep or maintain an animal, fowl, or bird (otherwise permitted to be kept) which by sound, cry, or behavior causes annoyance or discomfort or disturbs the repose of a reasonable person of normal sensitivity.

Nuisance is defined broadly: it generally includes any unreasonable or unlawful condition that interferes with the use of someone's property. Noisy parties in the middle of the night, smelly garbage, and dogs that won't stop barking are all nuisances to the person whose enjoyment of property is affected.

If asking the owner fails or they are too inconsiderate to think that leaving their dog outside at night,early in the morning, or all day while they are safely away at work or school wont; have their dog(s) barking at every movement or noise they can hear, then:

They are open Tuesday through Saturday.
Call (925) 335-8300, and press “0” for non-emergency.
Have the address of the offender available for the person filing the complaint. Request that they send you a form and that they send a notification of the complaint to the offending party. A 90-day clock starts ticking when they send it out.

Give the offender two weeks to voluntarily do something about their untrained dog, careless attitude, and if they do not rectify the situation, know that they care even less for you than for their dog. Many people in the US own dogs because it makes them feel powerful knowing something depends on them for its very survival. That kind of “loyalty” from an animal is like the loyalty of a masochist to a sadist: dysfunctional and based in a sick cruelty. Sadly, it's why many people also “own” kids: for power and a tax exemption. They avoid taking back their surrendered power to the global “pyramid scheme” and any sense of community foisted upon the government, and become slaves with slaves of their own. It's a poor substitute for being free when you have to make unfree a child, pet, or neighbor. Hopefully, a talk with a neighbor will work, but if a complaint has ever acted as a “please take notice” and nothing was done, then they refuse to give up their slaves by taking responsibility for their own actions and lack of actions. In the end, they will support someone like Stalin or Hitler because they inherently respect (and even crave) that kind of abusive power. How dare anyone be offended with their right to abuse. You see the same kind of entitlement in the cigarette smoker who throws their cigarette butt anywhere they please, after polluting your air with carcinogenic toxins. They are less human, and treat you likewise, with every abuse.

To have any impact, more than one neighbor must act within a 90-day period or the complaint is tossed, and the offender can keep on behaving in their unneighborly, discourteous, and uncaring manner. [Remember that leaving the animal out all night may be considered animal cruelty based on its fear, the temperature, and weather. You can abandon a child in a crowd, and these owners do it with their dogs, foisting responsibility onto neighbors who must bear the barking all day long and especially when they enter their own backyards for some form of enjoyment, which is constantly abated by the anxious and obnoxious barking of the dog.

If nothing you've tried helps, you can sue the owner of a barking dog, on the ground that the dog is a nuisance that interferes with your use and enjoyment of your home. The least painful route is through small claims court. Small claims court procedures are simple and designed to be used without a lawyer. In some states, including California, lawyers are barred from small claims court. Even if they aren't banned, you will rarely see one there because most people find it too expensive to hire them. Fees in small claims court are also low, and the process is relatively fast - which means you'll get to court in a few weeks or months, not years.

Winning a lawsuit in small claims court can get you money (and satisfaction), but probably nothing else. In most states, small claims court judges only have the power to order someone to pay money. They can't give you what you really want: a court order telling your neighbor to make the problematic pooch be quiet.

Still, making your neighbor fork over some money may be even more effective than a simple court order in convincing your neighbor to clean up his (or his dog's) act. And you can keep going back to court and asking for more as long as the nuisance continues.

If you absolutely must have a court order telling the neighbor to stop (the technical term for this kind of order is an injunction), you may have to go to "regular" court (often called circuit, superior or district court) instead of small claims court. For that, you'll probably need a lawyer, though you can bring a straightforward nuisance suit yourself, if you're willing to spend some hours in the law library finding out how to draw up the papers and submit them to the court.

In the end, it takes backbone and a community with backboned individuals to have rights to peace, quiet, and non-abuse by those manufactured as narcissistic, psychopathic, and sociopathic types.

A safe, aware, and mutually-respectful neighborhood starts with each person... you and me. It means that we take responsibility for our homes, yards, and choices. It means having pets for which we take full responsibility (biting, digging, barking, chasing, etc.), for homes (repairing, yard debris, etc.), for kids (bullying, abuse, mutually-guarding), driving (slowly, carefully), and “sales people” (which is oft-used as a precursor to breaking-and-entering, which utilizes trespassing to bother you at the front door, and which leaves trashy ads all over your front mat, front door, mailbox, in your driveway, or on your windshield).

And, if we do not create neighborhood “community”, then who will? Occupation forces? Surveillance cameras? It does end up that way, especially when psychopaths with guns want more power yet. Given that we do not want that, if we do not create it today, when will we start? Tomorrow? Later? Procrastination is what our nation is becoming... as we watch it intentionally bankrupted for the greed off the lofty and self-anointed “elite”. Only we can change the ugly world which they are creating. The adage, “good times come when you make them, and bad times come on their own”, says a lot. To me, it says that if we don't take responsibility for our freedoms then we will end up with none, and will deserve that sorry state.

If you're interested in more than the laws unenforced by a surrendered "community" held for ransom within the cold and Capital-harnessed State apparatus, then consider the workers and neighborhood councils easily found by a search engine on the web. Direct democracy, direct community, generalized self-management, and isocracy are worth your while, and that of your neighbor. They are a start in melting away the manufacture barriers and illusionary power we embrace with frozen knuckles and grimacing jaws. WE are our only hope. Times will always get worse when you do not own them as a community. Always.
